CONDITIONS G\u00c9N\u00c9RALES DE VENTE ET DE R\u00c9SERVATION (CGV)<\/h1>

Article 1 \u2013 Objet et Champ d'application<\/h3>

Les pr\u00e9sentes Conditions G\u00e9n\u00e9rales de Vente (CGV) r\u00e9gissent les relations contractuelles entre la soci\u00e9t\u00e9 orient Bay Management (exploitant le site stmartinvillasrentals.com) et toute personne (ci-apr\u00e8s le \u00ab Client \u00bb) effectuant une r\u00e9servation de logement de vacances (villa, appartement) situ\u00e9 \u00e0 Saint-Martin.<\/p>

Toute r\u00e9servation implique l'adh\u00e9sion enti\u00e8re et sans r\u00e9serve du Client aux pr\u00e9sentes CGV.<\/p>

Article 2 \u2013 Modalit\u00e9s de R\u00e9servation<\/h3>

  1. Demande et confirmation : La r\u00e9servation devient ferme apr\u00e8s r\u00e9ception du formulaire de r\u00e9servation compl\u00e9t\u00e9 et du versement d'un acompte.<\/p><\/li>

  2. Acompte : Sauf disposition contraire indiqu\u00e9e lors de la r\u00e9servation, un acompte de [ex: 30% ou 50%] du montant total du s\u00e9jour est exig\u00e9 au moment de la confirmation.<\/p><\/li>

  3. Solde : Le solde du s\u00e9jour doit \u00eatre r\u00e9gl\u00e9 au plus tard [ex: 30 jours avant la date d'arriv\u00e9e. Pour toute r\u00e9servation effectu\u00e9e moins de 30 jours avant l'arriv\u00e9e, l'int\u00e9gralit\u00e9 du montant est due \u00e0 la commande.<\/p><\/li><\/ol>

    Article 3 \u2013 Tarifs et Modes de Paiement<\/h3>

    • Tarifs : Les prix sont indiqu\u00e9s en Euros (EUR) ou Dollars US (USD) selon la s\u00e9lection du Client. Ils comprennent la mise \u00e0 disposition du logement meubl\u00e9, les charges d'eau\/\u00e9lectricit\u00e9 et les services de conciergerie de base mentionn\u00e9s dans le contrat.<\/p><\/li>

    • Frais annexes : La taxe de s\u00e9jour locale (si applicable) ainsi que les services additionnels command\u00e9s (ex: chef \u00e0 domicile, m\u00e9nage suppl\u00e9mentaire, location de voiture) seront factur\u00e9s en sus.<\/p><\/li>

    • Moyens de paiement accept\u00e9s : Carte bancaire (via plateforme s\u00e9curis\u00e9e Stripe), virement bancaire, ou tout autre moyen sp\u00e9cifi\u00e9 au moment du paiement.<\/p><\/li><\/ul>

      Article 4 \u2013 D\u00e9p\u00f4t de Garantie (Caution)<\/h3>

      Il sera restitu\u00e9 au Client dans un d\u00e9lai maximal de 7 jours apr\u00e8s le d\u00e9part, d\u00e9duction faite des retenues \u00e9ventuelles pour remise en \u00e9tat des lieux.<\/p>

      Ce d\u00e9p\u00f4t est destin\u00e9 \u00e0 couvrir les \u00e9ventuels d\u00e9g\u00e2ts ou d\u00e9gradations caus\u00e9s au logement ou aux \u00e9quipements.<\/p>

      The security deposit will be released or refunded within a maximum of 7 days after departure<\/strong>, less any amounts reasonably withheld to cover damage, missing items, excessive cleaning, or restoration costs.<\/p>

      Article 5 \u2013 Conditions d'Annulation<\/h3>

      Toute annulation par le Client doit \u00eatre notifi\u00e9e par \u00e9crit (e-mail) \u00e0 l'adresse orientbaymanagement@gmail.com.<\/p>

      • Annulation \u00e0 plus de 60 jours de l'arriv\u00e9e : Remboursement de l'acompte sous d\u00e9duction de 5% de frais de dossier.<\/p><\/li>

      • Annulation entre 31 et 60 jours avant l'arriv\u00e9e : L'acompte reste acquis \u00e0 l'h\u00e9bergeur.<\/p><\/li>

      • Annulation \u00e0 moins de 30 jours de l'arriv\u00e9e ou non-pr\u00e9sentation (No-Show) : 100% du montant total du s\u00e9jour est conserv\u00e9.<\/p><\/li><\/ul>

        Il est fortement recommand\u00e9 au Client de souscrire une assurance annulation de voyage personnelle.<\/p>

        Article 6 \u2013 Arriv\u00e9e et D\u00e9part (Check-in \/ Check-out)<\/h3>

        • Arriv\u00e9e : Les arriv\u00e9es s'effectuent g\u00e9n\u00e9ralement \u00e0 partir de 16h00. Un accueil personnalis\u00e9 est organis\u00e9 \u00e0 la villa ou au point de rendez-vous convenu.<\/p><\/li>

        • D\u00e9part : Les logements doivent \u00eatre lib\u00e9r\u00e9s avant 10h00 le jour du d\u00e9part. Tout d\u00e9passement horaire non autoris\u00e9 pourra donner lieu \u00e0 la facturation d'une nuit\u00e9e suppl\u00e9mentaire.<\/p><\/li><\/ul>

          Article 7 \u2013 Occupation des Lieux et Obligations des Occupants<\/h3>

          1. Capacit\u00e9 d'accueil : Le logement ne peut \u00eatre occup\u00e9 que par le nombre de personnes pr\u00e9vu au contrat de r\u00e9servation.<\/p><\/li>

          2. R\u00e8gles de vie : Le Client s'engage \u00e0 faire un usage paisible du logement et des installations (piscine, jardin, \u00e9quipements).<\/p><\/li><\/ol>

            Les f\u00eates, \u00e9v\u00e8nements de groupe non autoris\u00e9s et nuisances sonores excessives sont strictement interdits.<\/p>

            1. Piscine et S\u00e9curit\u00e9 : La surveillance des baignades dans les piscines priv\u00e9es rel\u00e8ve de la seule responsabilit\u00e9 des parents et adultes accompagnants.<\/p><\/li><\/ol>

              Orient Bay Management ne saurait se substituer \u00e0 la surveillance et \u00e0 la vigilance qui incombent aux adultes responsables.<\/p>

              Article 8 \u2013 Droit de R\u00e9tractation<\/h3>

              Conform\u00e9ment \u00e0 l'article L. 221-28 12\u00b0 du Code de la consommation fran\u00e7ais, les prestations de services d'h\u00e9bergement fournies \u00e0 une date ou selon une p\u00e9riodicit\u00e9 d\u00e9termin\u00e9e ne sont pas soumises au droit de r\u00e9tractation.<\/p>

              Article 9 \u2013 Droit Applicable et Juridiction Comp\u00e9tente<\/h3>

              En cas de litige relatif \u00e0 l'interpr\u00e9tation ou \u00e0 l'ex\u00e9cution de la r\u00e9servation, une solution amiable sera recherch\u00e9e avant toute action judiciaire.<\/p>

              GENERAL TERMS AND CONDITIONS OF SALE AND BOOKING Article 1 \u2013 Purpose and Scope These General Terms and Conditions of Sale and Booking (the \u201cTerms\u201d) govern the contractual relationship between Orient Bay Management, operator of the website stmartinvillasrentals.com, and any person (hereinafter referred to as the \u201cGuest\u201d or \u201cClient\u201d) making a reservation for vacation accommodation, including villas and apartments, located in Saint-Martin. By making a reservation, the Guest fully and unconditionally agrees to these Terms and Conditions. Article 2 \u2013 Booking Terms Booking Request and Confirmation:A reservation becomes firm and confirmed once the completed booking form has been received and the required deposit has been paid. Deposit:Unless otherwise stated at the time of booking, a deposit of \u00a030%\u00a0of the total rental amount is required to confirm the reservation. Final Balance:The remaining balance must be paid no later than 30 days before the scheduled arrival date. For reservations made less than 30 days before arrival, the full amount of the stay is due at the time of booking. Article 3 \u2013 Rates and Payment Methods Rates:Prices are quoted in Euros (EUR) or U.S. Dollars (USD), depending on the currency selected by the Guest. Rates include the rental of the furnished accommodation, water and electricity charges, and any standard concierge services expressly included in the booking agreement. Additional Charges:Local tourist taxes, where applicable, as well as any additional services requested by the Guest, such as a private chef, additional housekeeping, car rental, or other concierge services, will be charged separately. Accepted Payment Methods:Payments may be made by credit or debit card through the secure Stripe payment platform, by bank transfer, or by any other payment method specified at the time of payment. Article 4 \u2013 Security Deposit A security deposit, the amount of which varies depending on the property rented, may be required prior to check-in or release of the keys. The deposit may be collected by credit card pre-authorization, bank transfer, or another method communicated before arrival. The security deposit is intended to cover any damage, loss, or deterioration caused to the property, furnishings, equipment, or amenities during the Guest\u2019s stay. The security deposit will be released or refunded within a maximum of 7 days after departure, less any amounts reasonably withheld to cover damage, missing items, excessive cleaning, or restoration costs. Article 5 \u2013 Cancellation Policy Any cancellation by the Guest must be submitted in writing by email to orientbaymanagement@gmail.com. Cancellation more than 60 days before arrival:The deposit will be refunded, less a 5% administrative fee. Cancellation between 31 and 60 days before arrival:The deposit is non-refundable and will be retained by the accommodation provider. Cancellation 30 days or less before arrival, or in the event of a no-show:100% of the total booking amount will be retained and no refund will be issued. Guests are strongly encouraged to purchase their own travel and cancellation insurance. Article 6 \u2013 Check-In and Check-Out Check-In:Check-in is generally available from 4:00 PM. A personalized welcome will be arranged at the villa or at another agreed meeting point. Check-Out:The accommodation must be vacated no later than 10:00 AM on the day of departure. Any unauthorized late departure may result in an additional charge of up to one extra night. Article 7 \u2013 Property Use and Guest Responsibilities Maximum Occupancy:The property may only be occupied by the number of guests stated in the booking agreement. Respectful Use of the Property:Guests agree to use the accommodation and its facilities, including the swimming pool, garden, furniture, appliances, and other amenities, in a peaceful and responsible manner. Unauthorized parties, group events, gatherings, and excessive noise are strictly prohibited. Swimming Pool and Safety:Parents, guardians, and accompanying adults are solely responsible for supervising children and other persons using private swimming pools. Orient Bay Management cannot replace the supervision and vigilance required from responsible adults. Article 8 \u2013 Right of Withdrawal In accordance with Article L. 221-28, 12\u00b0 of the French Consumer Code, accommodation services provided for a specific date or period are not subject to the statutory right of withdrawal. Accordingly, the Guest does not benefit from a cooling-off or withdrawal period once the booking has been confirmed. Article 9 \u2013 Governing Law and Jurisdiction These Terms and Conditions are governed by French law. In the event of any dispute relating to the interpretation, validity, or performance of a booking, the parties agree to first attempt to resolve the matter amicably before initiating legal proceedings.
